These Terms of Service govern access to and use of BrainSpark, operated by QuintelX LLC. By using BrainSpark, you agree to these Terms. If you are a minor, use BrainSpark only with the involvement and permission of a parent or legal guardian. If you do not agree to these Terms, do not use the service.
BrainSpark provides AI-assisted educational questions and explanations for curiosity, practice, and learning. BrainSpark is not a school, accredited course, tutoring guarantee, professional-advice service, or substitute for a teacher, textbook, parent, guardian, or qualified professional.
BrainSpark's current service does not require learner accounts and does not maintain persistent server-side learner profiles or identity-linked saved progress. Some preferences and progress information are stored locally in the browser and may be lost if site data is cleared, blocked, reset, or accessed from another device.
Users may report a question through fixed-choice controls. Reports help support content review but do not require BrainSpark to remove, correct, or respond to a particular question within a specific timeframe. Feedback voluntarily provided to BrainSpark may be used to operate, maintain, and improve the service.
BrainSpark, its branding, software, interface, and original or curated materials are owned by QuintelX LLC or its licensors and are protected by applicable law. Subject to these Terms, BrainSpark grants users a limited, revocable, non-exclusive, non-transferable right to use the service for personal educational purposes. Third-party names, trademarks, and materials remain the property of their respective owners.
BrainSpark may modify, suspend, restrict, or discontinue any part of the service; change topics, features, models, or service providers; correct or remove content; and impose reasonable operational limits. BrainSpark does not promise uninterrupted availability, preservation of browser-local progress, or continued access to any particular question or feature.
BrainSpark's Privacy Policy explains how information is processed in connection with the service and is incorporated into these Terms by reference. Do not use BrainSpark to submit another person's personal information without appropriate authority.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRAINSPARK IS PROVIDED “AS IS” AND “AS AVAILABLE.” QUINTELX LLC DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETE, OR ACCURATE. TO THE EXTENT PERMITTED BY LAW, IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, ARE DISCLAIMED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, QUINTELX LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, USE, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO BRAINSPARK. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LEGALLY BE EXCLUDED OR LIMITED, INCLUDING NON-WAIVABLE RIGHTS UNDER APPLICABLE CONSUMER LAW.
To the extent permitted by applicable law, an adult user or a parent or guardian responsible for use of BrainSpark agrees to indemnify and hold QuintelX LLC harmless from claims arising from unlawful use of the service, violation of these Terms, or infringement of another person's rights. This provision does not apply where prohibited by applicable consumer law.
BrainSpark may block, suspend, or restrict access when QuintelX LLC reasonably believes use violates these Terms, threatens users or systems, or creates legal, security, or operational risk. Provisions that by their nature should survive termination will continue to apply.
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles, except where mandatory consumer-protection or other non-waivable laws of a user's jurisdiction apply. Nothing in these Terms limits rights that cannot be waived under applicable law, including rights that may apply to users in India or elsewhere.
Any dispute that cannot be resolved informally will be handled in a court of competent jurisdiction, subject to any mandatory venue, consumer-protection, or other non-waivable requirements that apply to the user. These Terms do not require arbitration.
BrainSpark may update these Terms from time to time. When changes are made, the revised version and updated date will be posted on the website. Continued use of BrainSpark after revised Terms become effective means that the updated Terms apply, subject to applicable law.
